1. The TUMI Exclusives Club member (collectively the “Membership”) is organized by TUMI. You are entitled to enjoy certain benefits with the Membership. All Membership benefits as well as any further terms regarding how you can access such benefits as a holder of the Membership or otherwise applicable to such benefits, such further terms being incorporated by reference into these Terms and Conditions. The Membership including its possession of and use by you shall be subject to the Terms and Conditions in effect at the time of use of the Membership by you. Yours use of the Membership is deemed acceptance by you of these Terms and Conditions.

2. To the maximum extent permitted by law, TUMI shall have absolute right to revise these Terms and Conditions (including amending any of the Membership’s benefits or how you can access such benefits) at any time at its sole discretion.

3. If you wish to enjoy the benefits under the Membership, you shall provide your contact details, i.e. your telephone number and/or e-Membership issued by TUMI from time to time for our verification purpose before checking out.

4. TUMI shall have sole discretion to upgrade and/or downgrade your Membership level without further confirmation.

5. You will accumulate 1 TUMI Point (“Point”) in your TUMI Lifetime Balance for every THB 1 spending at TUMI stores (directly operated by Samsonite) in the Kingdom of Thailand (“Thailand”), and the online store at www.tumi.co.th, upon the expiry of seven (7) calendar days following the date of purchase. There is no expiry date for accumulated Points. You will be assigned to different Loyalty Levels (namely: Regular, Silver, and Gold) according to the number of accumulated Points in your TUMI Lifetime Balance, and you will enjoy benefits in accordance with https://www.tumi.co.th/en/tumi-exclusives-club.html pursuant to the your Loyalty Level

6. The Membership Privilege may be cancelled and these Terms and Conditions may be terminated by either: (a) the Member at any time upon giving written notice to TUMI; or (b) TUMI, to the maximum extent permitted by law, at any time (at its sole discretion) upon giving written notice to the Members.

7. To the maximum extent permitted by law, TUMI (including its directors, officers, agents, consultants and associates, along with Samsonite Thailand’s related companies (including affiliate and subsidiary companies) is not liable to you for any loss, damage or liability (whether direct, consequential, indirect, economic or otherwise) incurred by you in relation to the Membership, including in relation to: (a) your use of the Membership; (b) if the Membership is used by any third party, whether with or without your permissions; (c) your loss of the Membership details (or any liability incurred via your loss of the Membership details, whether before or after you notify us regarding your loss of the Membership details); (d) any revisions to these Terms and Conditions (including revisions to any of the Membership’s benefits); (e) any cancellation of the Membership; or (f) any breach of these Terms and Conditions by you.

8. You acknowledge and agree that any personal data which you provide to TUMI in your application for or use of the Membership will be collected, used and stored in accordance with our Privacy Policy available at https://www.tumi.co.th/en/member-regulations.html and applicable law.

9. To provide you with TUMI Thailand’s benefits, newsletters and/or promotional materials in a timely and quality manner, please keep TUMI updated whenever you changed your personal information, i.e. email address, correspondence address or contact telephone number, so that TUMI can update its records accordingly.

10. The Membership is available for any TUMI stores (a list of stores can be found at https://www.tumi.co.th/en/stores in Thailand.

11. In case of any dispute, TUMI reserves the right to reasonably interpret these Terms and Conditions if any of them are unclear or equivocal. These Terms and Conditions shall be governed and construed in accordance with the laws of Thailand (including where any issues arise in respect of the use of the Membership in Thailand).

12. These Terms and Conditions are drafted in both Thai and English. In case of discrepancies, the Thai version shall prevail.
